Terms of use

 1.General Provisions 

• This User Agreement (the "Agreement") applies to the website located at https://xtsch.com/ (the "Site"). 
• The Site is a property of the "WORLDWIDE WORLD" Limited Liability Company. 
• This Agreement governs the relationship between the Administration of www.xtsch.com (hereinafter - the Administration of the site) and the User of this Site. 

• The Administration reserves the right to change, add or delete paragraphs of this Agreement at any time without notice to the User. 
• Continued use of the Site by the User means acceptance of the Agreement and the changes made to this Agreement. 
• User is personally responsible for checking this Agreement for changes in it. 

2.Definitions of Terms 

• The terms listed below have the following meaning for the purposes of this Agreement: 

• https://xtsch.com/ - Internet resource located at the domain name xtsch.com, operating through the Internet resource and its associated services. 
• Internet resource - a site containing information about Goods, the Seller, allowing to choose, order and (or) purchase Goods. 
• Administration of the site of the Internet resource is the authorized employees for the management of the Site, acting on behalf of the "WORLD AT ALL WORLD" Limited Liability Company. 
• User of the Website (hereinafter referred to as "User") - a person who has access to the Site via the Internet and uses the Site. 
• The content of the Website (hereinafter referred to as Content) - protected results of intellectual activity, including texts of literary works, their titles, prefaces, abstracts, articles, illustrations, covers, musical works with or without text, graphic, text, photographic, derivative, composite and other works, user interfaces, visual interfaces, trademark names, logos, computer programs, databases, as well as design, structure, selection, coordination, appearance, general style and arrangement 

3.Subject of the Agreement 

• The subject of this Agreement is to provide the User of the Internet resource with access to the Goods and services contained on the Site. 
• The online resource provides the User with the following types of services 
• access to information about the Goods and to information on the purchase of the Goods; 
• Other types of services realized on the pages of the Internet resource, including paid services. 

• This Agreement covers all existing (actually functioning) at the moment services of the Internet resource, as well as any their further modifications and additional services of the Internet resource that appear in the future. 
• Access to the Internet resource is provided on a free-of-charge basis. 
• This Agreement is a public offer. By accessing the Site, the User is deemed to have acceded to this Agreement. 
• Use of the materials and services of the Site is governed by the norms of the current legislation of the Russian Federation. 

4.Rights and obligations of the Parties 

• The Site Administration has the right: 
• To change the rules of use of the Site, as well as to change the content of this Site. The changes shall come into force upon the publication of the new edition of the Agreement on the Site. 
• Limit access to the Site if the User violates the terms of this Agreement. 
• Gather, analyze, use information about the User, contained on the Site, including, but not limited to, information about the contact and personal data of the User, information about the User's actions on the Site, etc. 
• User has the right to: 

• Gain access to use the Site. 
• Use all of the services available on the Site, and purchase any Goods offered on the Site. 
• Ask any questions related to the services of the Internet resource for details, which are in the "contacts" section of the Site. 
• Use the Site only for the purposes and in the manner prescribed by the Agreement and not prohibited by the legislation of the Russian Federation. 
• The User of the Site undertakes: 

• Provide upon request of the Site Administration additional information, which is directly related to the services provided by the Site. 
• Comply with property and non-property rights of the authors and other holders of rights when using the Site. 
• Not to take actions, which can be considered as disturbing normal operation of the Site. 
• Not to distribute any confidential information about individuals or legal entities, protected by the legislation of the Russian Federation, using the Site. 
• Avoid any actions which may result in a violation of the confidentiality of information protected by the legislation of the Russian Federation. 

• Do not use the Site to distribute advertising information, except with the consent of the Administration of the site. 
• Do not use the services of the site Internet resource in order to: 
• download content that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred and (or) discrimination on racial, national, gender, religious, social grounds; contains false information and (or) insults to specific individuals, organizations, authorities. 
• Incitement to commit illegal actions, and assistance to persons whose actions are aimed at violating the limitations and prohibitions in force on the territory of the Russian Federation. 
• Violation of the rights of minors and (or) causing harm in any form. 

• infringement of the rights of minorities. 
• impersonating another person or representative of an organization and (or) community without sufficient rights, including employees of this Internet resource. 
• misleading about the features and characteristics of any Product from the catalog of the Internet resource posted on the Site. 
• improper comparison of the Goods, as well as the formation of a negative attitude towards persons who (do not) use certain Goods, or condemnation of such persons. 
• User is prohibited: 

• Use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or monitor the content of the Website of this Internet resource; 
• Disrupt the proper functioning of the Site; 
• By any means circumvent the navigational structure of the Site to obtain or attempt to obtain any information, documents or materials by any means not specifically provided by the services of this Site; 
• Unauthorized access to the functions of the Site, any other systems or networks related to this Site, and any services offered on the Site; 
• Violate the security or authentication system of the Site or any network related to the Site. 

• Perform reverse lookups, trace or attempt to trace any information about any other User of the Site. 
• Use the Site and its Content for any purposes prohibited by the legislation of the Russian Federation, as well as incite any illegal activity or other activity, which violates the rights of the Internet resource or other persons. 

5.Use of the Site 

• The Site and the Content included in the Site are owned and operated by the Site Administration. 
• The Site content cannot be copied, published, reproduced, transmitted or distributed by any means, as well as placed on the Internet without prior written consent of the Site Administration. 

• The content of the Site is protected by copyright, trademark law and other rights related to intellectual property and unfair competition law. 
• Certain services of the Site may require the creation of a User account. 
• The User is personally responsible for maintaining the confidentiality of their account information, including their password, and for any and all activities on behalf of the User of their account. 
• The User must immediately notify the Administration of any unauthorized use of their account or password or any other breach of security. 
• This Agreement applies to all additional terms and conditions on the purchase of Goods and services provided on the Site. 

• The information placed on the Website shall not be construed as an amendment of this Agreement. 
• The Site Administration has the right to change the list of Goods and services offered on the Site and (or) the prices applicable to such Goods on their sale and (or) the services provided by the Internet resource at any time without notice to the User. 

6.Liability 

• Any losses that the User may incur in case of intentional or negligent violation of any provision of this Agreement, as well as due to unauthorized access to the communications of another User, the Site Administration is not compensated. 
• The Site Administration is not responsible for: 

• Delays or failures in the process of carrying out operations, resulting from force majeure, as well as any case of failure in telecommunications, computer, electrical and other related systems. 
• Actions of transfer systems, banks, payment systems and for delays connected with their work. 
• The proper functioning of the Site, if the User does not have the necessary technical means to use it, as well as has no obligation to provide users with such means. 
• The content of the information posted on the Site. 
• User is solely responsible for the interpretation and use of the content (information) posted on the Site. 

7.Breach of User Agreement 

• The Site Administration has the right to disclose any information collected about the User of this Site, if the disclosure is necessary in connection with an investigation or complaint of misuse of the Site, or to identify the User, who may violate or interfere with the rights of the Administration or other Users of the Site. 
• The Administration has the right to disclose any information about the User, which it considers necessary to comply with the provisions of applicable law or court decisions, to ensure compliance with the terms of this Agreement, the protection of the rights or the safety of the Administration of the Site and Users. 
• The Administration has the right to disclose information about the User, if the current legislation of the Russian Federation requires or permits such disclosure. 
• The Administration has the right, without prior notice to the User, to terminate and/or block access to the Site, if the User has violated this Agreement or the terms of use contained in other documents, as well as in the event of termination of the Site, or due to a technical failure or problem. 

• The Site Administration shall not be liable to the User or any third party for termination of access to the Site if the User has violated any provision of the present Agreement or any other document containing the terms of use of the Site. 

1. Settlement of Disputes

• In case of any disagreements or disputes between the Parties to this Agreement, the mandatory condition precedent to recourse to court is the presentation of a claim (written offer to voluntarily resolve the dispute). 
• Within 30 (thirty) calendar days from the date of its receipt, the claimant shall notify the claimant in writing about the outcome of the claim. 
• If it is impossible to resolve the dispute voluntarily, either Party may apply to court to protect its rights, which are granted to it by the current legislation of the Russian Federation. 

• Any claim in relation to the terms of use of the Website shall be filed within the period after the grounds for the claim arise, except the protection of copyright in legally protected materials of the Website. 

1. Additional Terms

• The Administration shall not accept any counter-offers from the User regarding any amendments to this User Agreement. 
• User reviews posted on the Site are not confidential and may be used by the Site Administration without any restrictions.
